BAD&G CUSTOMS LLC – Terms of Use

Welcome to BAD&G CUSTOMS (“BAD&G,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of our website, www.badgcustoms.com (the “Site”) and any purchase you make through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Acceptance of Terms
By using our Site, you agree to comply with and be bound by these Terms of Use and our policies posted on the Site (including our Refund Policy, Shipping Policy, and Privacy Policy).
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Site and to make purchases.
3. Account Registration
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information and to update it as needed.
4. Prohibited Activities
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
- Copy, reproduce, distribute, publicly display, modify, create derivative works of, or exploit any portion of the Site or its content without our written permission.
- Attempt to interfere with the Site’s security, functionality, or access (including by introducing viruses, scraping, or automated attacks).
- Use any automated means (bots, spiders, scrapers) to access the Site without our written consent.
5. Products, Orders, and Purchases
5.1 Product Information
We strive to display products and descriptions as accurately as possible. However, we do not guarantee that product descriptions, colors, measurements, or other content are accurate, complete, reliable, current, or error-free.
5.2 Pricing and Availability
Prices and availability are subject to change without notice. We reserve the right to correct pricing errors, cancel orders, or limit quantities at any time.
5.3 Order Acceptance and Cancellation
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized transactions, or product availability issues. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.
5.4 Payment
By submitting payment information, you represent and warrant that you are authorized to use the selected payment method. All payments are subject to validation checks and authorization by the payment provider.
6. Made-to-Order & Custom Items
6.1 Made-to-Order Production
Most BAD&G products are made to order. Production times shown on the Site are estimates and may change due to material availability, workload, holidays, or other factors. We’ll do our best to meet stated timelines, but production and shipping dates are not guaranteed.
6.2 Customizations, Upgrades, and Final Sale Items
Any product that is customized or modified beyond default options is considered a custom item. This includes (but is not limited to) Custom Seats, leather upgrades, hardware changes, thread color changes, size/volume changes, special requests, or any other non-standard build.
Because custom items are built specifically for you, custom and modified items are non-refundable once production has started and may be exchangeable one time only if approved by BAD&G CUSTOMS. If an exchange is approved, the customer is responsible for shipping costs.
6.3 Fitment Responsibility
It is the customer’s responsibility to confirm fitment and compatibility before ordering. Motorcycle setups can vary due to year/model differences, aftermarket parts, exhaust systems, suspension changes, and prior modifications. If you have any questions about fitment, contact us before placing your order so we can help confirm the best option.
7. Warranty
We stand behind our craftsmanship. BAD&G CUSTOMS products are covered by a Lifetime Warranty against defects in materials and workmanship. This warranty covers structural failures (such as stitching, leather integrity, and hardware attachment) under normal use. It does not cover normal wear and tear, neglect, accidents, or damage caused by improper mounting or modification. Please refer to our separate Warranty page for full claim procedures.
8. Shipping and Returns
Shipping times, delivery estimates, and return eligibility are described in our Shipping Policy and Refund Policy. Those policies are incorporated into these Terms by reference.
9. Intellectual Property
All content on this Site, including text, graphics, logos, product designs, images, photos, videos, and software (collectively, “Content”), is
